Arizona’s Wrongful Death Process

In Arizona, the right to file a wrongful death lawsuit is strictly governed by state statute (A.R.S. § 12-612). Unlike some states that allow a broad range of relatives to sue, Arizona limits this right to a specific group of "statutory beneficiaries."

Only the following people may bring a wrongful death claim:

The surviving spouse
Surviving children, including both biological and legally adopted children
Surviving parents or guardians
The personal representative - if none of the above survives, a court-appointed executor of the deceased’s estate may file on behalf of the estate

Even if multiple family members are eligible to sue, Arizona law typically requires that one single lawsuit be filed on behalf of all beneficiaries.

The statutory plaintiff: One eligible person (often the spouse) acts as the "statutory plaintiff" for the entire family.
Collective representation: This individual represents the interests of all other beneficiaries (e.g., children and parents) during the legal proceedings.
Distribution of damages: If the case is successful, the compensation is distributed among the beneficiaries "in proportion to their damages," as determined by a judge or jury.

Critical Deadlines: The Statute of Limitations

In Arizona, you generally have two years from the date of the person's death to file a wrongful death claim.

However, there are two major exceptions:

Claims against government entities. If the death was caused by a public employee or government agency (like a city bus or a state-run facility), you must file a formal Notice of Claim within 180 days, and the lawsuit must be filed within one year.
Minor children. If the only beneficiary is a minor, the two-year clock may be "tolled" (paused) until they turn 18.
