Arizona Dog Bite Law

Arizona follows strict liability for dog bite injuries. Under Arizona Revised Statutes § 11-1025, a dog owner is automatically responsible:

• When their dog bites a person in a public place
• When the victim is lawfully on private property, such as a delivery driver or a guest

This holds even if the dog has never bitten before and the owner had no prior notice of aggression. Victims do not need to prove negligence to recover compensation. Arizona also holds owners liable when their dog is “at large,” off-leash, or not confined, and causes injury or property damage.

Common defenses of dog owners may include provocation or trespass, but these are often narrow exceptions. Proper legal guidance is critical to navigating these issues.

Arizona’s New 2025 Dog Bite Law & What It Means for Victims

In September 2025, Arizona enacted Senate Bill 1241, often referred to as the “Bite and Run Law,” which strengthens protections for dog bite victims. Under this law, a person who owns or is responsible for a dog that bites someone must provide the victim with the dog owner’s contact information at the time of the incident. 

This requirement applies whether the bite occurs in a public place or where the victim is lawfully present on private property, including the dog owner’s own yard. Failure to comply can now be charged as a Class 2 misdemeanor under Arizona law, with potential fines or even jail time.

Before this amendment to our state’s dog bite law, owners were only obligated to report dog bites to animal control, not to the victim directly. The new contact information requirement ensures victims can obtain crucial details immediately, such as vaccination status, insurance information, and owner identity, which are essential for both health care decisions and future legal claims. 

The Severity & Prevalence of Dog Bite Injuries

Dog bites are a significant public health and legal issue both nationally and in Arizona:

• The American Veterinary Medical Association estimates 4.5 million dog bites occur each year in the U.S., with around 800,000 requiring medical care and nearly 50% involving children under 12.
• In Arizona alone, there were over 34,000 emergency department visits and more than 2,300 hospitalizations for dog bite injuries from 2008–2012, according to state health statistics.
• Arizona ranked among the top states in dog bite insurance claims filed in 2021, with hundreds of claims annually and average payouts in the tens of thousands of dollars.

These statistics reflect not only the frequency of dog bites but also the seriousness of injuries that require medical intervention, hospitalization, reconstructive surgery, or long-term care.

Catastrophic Dog Bite Injuries

Some dog attacks result in high-stakes, catastrophic injuries, including but not limited to:

• Severe lacerations and deep tissue damage
• Facial and head trauma requiring reconstructive surgery
• Nerve damage leading to permanent loss of sensation or function
• Amputations or limb injuries
• Spinal cord or brain injuries
• Broken, damaged, or lost teeth requiring dental surgery and repair
• Disfigurement and permanent scarring
